Terms of Service
Effective August 26, 2026
These terms are the agreement between InboxTender and the business using it. They are deliberately short and specific: what we do, what you are responsible for, what things cost, and how either of us can walk away.
This page is operated by InboxTender. InboxTender is a software service that answers calls, texts, chats and email on behalf of the businesses that subscribe to it. If you reached this page from a message, a call or an email you received, the business you contacted uses InboxTender — the business remains your point of contact, and this document explains our role behind it.
1. The agreement
These Terms of Service govern your use of InboxTender (the "Service"). By creating an account or using the Service you agree to them. If you are agreeing on behalf of a company, you confirm you are authorized to bind that company, and "you" means that company.
2. What the Service does
Depending on your plan and connected channels, InboxTender answers phone calls, text messages, WhatsApp and Instagram messages, and website chat on your behalf using the briefing you give it. It also prepares email replies, but every email reply must be approved or written by a person before it is sent. The Service can answer questions, qualify buyers, capture leads, collect preferred times for your team to confirm, send eligible SMS follow-ups from a Front Desk line, create owner-approved personalized SMS broadcasts, and hand conversations to you. AI replies are sent under your business identity only when the channel and your settings permit it.
3. Your account
- You must be at least 18 and use the Service for a business, not for personal or household purposes.
- Keep your account details accurate and your credentials secret. You are responsible for activity under your account.
- Tell us promptly at hello@inboxtender.com if you believe your account has been compromised.
4. What you are responsible for
The assistant speaks in your name, so the messages it sends are your messages. You agree to:
- Brief it accurately. Prices, availability, policies and promises come from you.
- Review every email draft before it is sent. Review other drafts the Service flags, and set eligible channel topics to draft or off when a mistake would be costly.
- For promotional or broadcast texts, message only people who gave you legally sufficient consent. A prior conversation alone is not promotional consent. Honor every opt-out.
- Comply with the law that applies to you, including telephone and messaging rules (such as the TCPA and carrier and CTIA guidelines), call-transcription and consent laws, email rules such as CAN-SPAM, consumer protection and advertising law, and the platform policies of WhatsApp, Instagram and Meta.
- Keep prohibited content out of your channels: unlawful, deceptive, harassing, hateful or explicit material, and any category carriers forbid — including sex, hate, alcohol, firearms and tobacco content in text messaging.
- Not use or rely on the Service for emergency communications or to contact emergency services.
5. Phone numbers and telephony
- Front Desk provisions a separate AI phone line. You may publish that line or ask your carrier to conditionally forward calls from an existing number. Your existing number remains with your carrier; forwarding availability, codes and charges depend on that carrier.
- Self-serve phone and SMS registration currently requires a business entity registered in the United States with its own EIN. Sole proprietors are not supported yet. You must provide the business's real legal entity type and registration details; do not select a different type to work around carrier eligibility rules. Registration also requires public privacy-policy and terms pages for the business.
- Calls and messages are carried by third-party carriers and platforms. Delivery, latency and availability depend on them, and outages or filtering can occur outside our control.
- You confirm you are entitled to use any number, email address or social account you connect to the Service.
6. AI output
The assistant can make mistakes. It is instructed never to invent prices, inventory or commitments, and to escalate what it is unsure about — but no AI system is perfect. You are responsible for reviewing what matters, and you accept the risk of relying on automated replies. Nothing the assistant produces is legal, medical, tax or financial advice.
7. Plans, billing and minutes
- Responder — $19/month. WhatsApp and Instagram answering, email drafts for approval, lead capture, autonomy controls and takeover. Responder does not include a new phone or SMS line. Existing Responder workspaces with a previously connected texting line may retain one-to-one SMS follow-ups for compatibility; setting up SMS follow-ups on a new line requires Front Desk.
- Front Desk — $49/month. Everything in Responder, plus an InboxTender phone and SMS line, eligible one-to-one SMS follow-ups, transcripts for calls the AI answers and lead capture. It includes up to 100 total minutes each month across inbound and outbound calls handled through InboxTender.
- Subscriptions are billed monthly in advance and renew automatically until canceled. Every inbound or outbound call handled through InboxTender counts toward the allowance. There are no per-minute overage charges; new calls pause when the allowance is used and resume at the next monthly reset.
- Cancel any time from your account; access continues to the end of the period you have paid for. We do not refund partial periods except where the law requires it.
- Prices exclude taxes. We may change prices with at least 30 days' notice by email; the change applies from your next renewal, and you can cancel before it takes effect.
8. Text messaging terms
- Recipients can reply STOP, UNSUBSCRIBE, CANCEL, END or QUIT at any time to stop messages, and HELP for assistance.
- Message frequency varies. Message and data rates may apply.
- Carriers are not liable for delayed or undelivered messages.
- You are the sender of record for messages sent from your channels and are responsible for the consent behind them.
- SMS broadcasts require recorded promotional permission and an owner attestation for each broadcast that every selected recipient agreed to receive promotional texts. A phone number, imported contact or prior service conversation alone does not grant that permission.
9. Third-party services
The Service depends on third parties — carriers, WhatsApp and Instagram, email providers, AI model providers and payment processing. Their terms apply to their part of the chain, and changes they make can affect what the Service can do. We will tell you about material changes we know about in advance.
10. Your data
Your business information and conversations remain yours. You grant us the license needed to host, process and transmit them in order to operate the Service, including sending the necessary parts to the model providers that generate replies. How we handle personal information is described in our Privacy Policy. You can export or delete your data at any time by asking us.
11. Acceptable use
You agree not to:
- Send bulk unsolicited messages, or use the Service to spam, defraud, phish or impersonate.
- Attempt to break, overload, reverse engineer or gain unauthorized access to the Service or its providers.
- Resell or white-label the Service without our written agreement.
- Use the Service in a way that puts our carrier or platform relationships at risk.
12. Availability and changes
InboxTender is an early-stage service and is offered without an uptime commitment. We work to keep it running and will be straight with you when something breaks. We may add, change or remove features; if we remove something you materially rely on, you may cancel and we will refund the unused part of that month.
13. Suspension and termination
You may stop at any time. We may suspend or terminate an account that breaches these terms, creates legal or carrier risk, or has an unpaid invoice — with notice where circumstances allow, and immediately where they do not. After termination we delete your data as described in the Privacy Policy.
14. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the assistant's replies will be accurate, that messages will be delivered, or that the Service will be uninterrupted or error-free.
15. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability arising out of or relating to the Service is limited to the greater of the fees you paid us in the 12 months before the claim, or $100.
16. Indemnity
You agree to indemnify and hold InboxTender harmless from claims, damages and costs (including reasonable legal fees) arising from your use of the Service, the content of the messages sent from your channels, or your breach of these terms or of applicable law.
17. Governing law and disputes
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The state and federal courts located in San Diego County, California have exclusive jurisdiction, and both parties consent to that venue. Before filing anything, email us — nearly everything is faster to fix by conversation.
18. Changes to these terms
We update the effective date at the top when these terms change, and we email account holders before material changes take effect. Continuing to use the Service after that date means you accept the updated terms.
